Terms of Service
1. Agreement to terms
These Terms of Service (“Terms”) govern your use of KaosLab (the “Service”), operated by KaosLab (the “Company”). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. What KaosLab is
KaosLab is a web-based TOEIC coaching service for Mandarin-speaking learners. It serves ready-made English practice items (reading and listening), scores your performance on a TOEIC-anchored scale, schedules spaced-repetition review, and tracks your estimated readiness over time. The Service is delivered as a hosted website; there is no native app.
3. Your account
You can complete the initial placement assessment as a guest; guest access is limited to the placement flow. Afterward, you must link a Google account to reveal and retain the placement result and continue into the rest of the Service. You are responsible for keeping your Google account secure. You must be at least 13 years old to use the Service; by using it you confirm you meet this requirement.
4. Acceptable use
The Service and its practice content are provided for your personal study under a personal, non-transferable license. You do not acquire ownership of the content. You agree not to:
- use the Service in any way that is illegal where you live;
- copy, resell, redistribute, publish, or scrape the practice items, answers, or explanations;
- use automated means to extract content, or attempt to disrupt, overload, probe, reverse-engineer, or gain unauthorized access to the Service;
- use the Service to abuse, harass, or harm any person.
We may suspend or restrict access that violates these rules.
5. Practice content and scoring
KaosLab’s practice items, answers, and explanations are prepared in advance with the help of AI and reviewed before they are served. They may still contain occasional errors and are provided as study aids, not as an authoritative reference.
Your scores, estimated level, and readiness figures are indicative study signals generated from your practice — they are not a prediction or guarantee of your official TOEIC result. Treat them the way you would treat a well-informed practice test: useful for direction, not a promise of any exam outcome.
6. The Pro pass, billing, and refunds
The Service offers a free tier and a paid Pro tier. The two tiers differ only in usage limits — Pro raises the daily and periodic limits on the same features. No feature is exclusive to Pro.
Free tier: limited daily usage. No payment information required.
Pro: a one-time Season Pass — NT$959 for 90 days of Pro, which raises your usage limits. It is a single upfront payment, not a subscription, and there is no free trial.
One-time purchase — no auto-renewal. The pass does not renew and never charges you again. When the 90 days end, your account returns to the free tier automatically; there is no subscription to cancel and no billing portal to manage. To continue Pro, buy another pass, which starts a fresh 90-day period.
Refunds: The pass unlocks the full Pro service immediately, so all sales are final and purchases are non-refundable — including any unused days if you stop using Pro or delete your account before the 90 days end. Because Pro is a digital service delivered and usable the moment you buy it, the 7-day cooling-off right for distance sales under Taiwan’s Consumer Protection Act (Article 19) does not apply — a recognized exception for online services completed upon delivery. By purchasing, you consent to immediate access and acknowledge this. If you were charged in error, email abc.with.kevin@gmail.com.
Payments are processed by Lemon Squeezy, which acts as our Merchant of Record and handles checkout, invoicing, and applicable taxes. By purchasing you also agree to Lemon Squeezy’s terms. We never receive or store your full card details.
7. Termination
You may stop using the Service at any time. To delete your account and associated data, email us (see §12); we process deletions as described in our Privacy Policy. We may suspend or terminate your account if you materially violate these Terms, with notice where reasonable.
8. No warranty
The Service is provided “as is”. To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, that its content will be accurate, or that your use will produce any particular exam score.
9. Limitation of liability
To the maximum extent permitted by law, the Company’s total liability for any claim arising from these Terms or your use of the Service will not exceed the greater of (a) NT$1,000 or (b) the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
10. Changes to these Terms
We may update these Terms. If changes are material, we will notify you by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
11. Governing law
These Terms are governed by the laws of Taiwan, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Taipei, Taiwan.
